Terms and conditions of sale

1. Seller — 领航荟(广州)国际贸易代理有限公司 (Co.,LTD), a company incorporated under Chinese law operating the brand BLACK CHINA — Trade & Consulting (the “Provider”). Registered office: Office 309-3011, floor 3, No.63, Panfu Road, Yuexiu District — Guangzhou, Guangdong, China. Contact: contact@black-china.com.

2. Scope — These terms apply to all orders placed on black-china.com. They distinguish (a) the digital products of the BLACK CHINA Starter Kit and (b) services (sourcing, OEM/ODM, quality control, logistics, support in China, consultation).

3. Digital products — Prices: prices are shown in euros, all taxes included; no additional tax is added at checkout. The applicable price is the one displayed when the order is placed.

4. Digital products — Payment: payment is made online through Stripe. The Provider never has access to full card details. The order is final once payment is confirmed.

5. Digital products — Delivery: files are made available immediately after payment confirmation on a secure download page, and a confirmation email is sent to the address provided. Download links are temporary; in case of access problems, the customer writes to contact@black-china.com with their order number.

6. Digital products — Right of withdrawal: this is digital content not supplied on a tangible medium. Before payment, the customer ticks a mandatory, unticked box requesting immediate access and acknowledging the loss of the right of withdrawal, in accordance with Article L221-28 13° of the French Consumer Code. This consent is time-stamped, recorded with the order (version and accepted text) and restated in the confirmation email, which serves as confirmation on a durable medium.

7. Digital products — Refunds: once the content has been made available, no refund is granted for a simple change of mind. This never excludes the customer's mandatory statutory rights, including the legal guarantee of conformity for digital content, defective or inaccessible content and double billing. Depending on the situation, the Provider replaces the content, restores access or issues a refund. See the Refund policy.

8. Digital products — Licence and intellectual property: the files remain the property of the Provider. The purchase grants a personal, non-exclusive, non-transferable licence for the customer's own use or that of their own business. Reselling, sharing, redistributing, reproducing for third parties or making the files publicly available, free or paid, is prohibited.

9. Services — Each service is subject to a quote or specific terms setting out its content, price, payment terms, timelines and cancellation and refund conditions. In case of conflict, the accepted quote or specific terms prevail over these terms. The Provider acts under a best-efforts obligation; final purchasing decisions with suppliers belong to the customer.

10. Liability — The Provider's liability is limited to direct and foreseeable damage resulting from a breach of its obligations, to the extent permitted by law. Digital content and tools (calculators, templates) are decision aids and do not replace legal, customs or tax advice.

11. Personal data — Data processing is described in the Privacy policy.

12. Disputes — In case of dispute, the customer is invited to first contact contact@black-china.com to seek an amicable solution. These provisions do not deprive consumers of the protection granted by the mandatory rules of the law of their country of residence.
